GREAT PARK ACTIVITY WAIVER

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING, AS IT IMPACTS YOUR LEGAL RIGHTS.

A completed version of this form is required to participate in the following attractions:

• Great Park Balloon Rides
• Great Park Carousel

This document is a waiver and not a registration. Waivers are valid for the day they are completed only, and do not guarantee the ability to participate in any activity. This waiver does not reserve any place on a participation list for any activity.

Waivers are for adult passengers only. All persons under the age of 18 must receive written authorization by a parent or guardian.

For Great Park Balloon Rides, children under the age of 13 must be accompanied by an adult.

In consideration for the ability of the persons named above to participate in the activities indicated below, and to the fullest extent permitted by law, I hereby agree to release, indemnify, defend (with counsel selected by releasees), and hold harmless on behalf of myself (and any minor children listed above) the City of Irvine, the Orange County Great Park Corporation, Aerophile California LLC, and their officers, clients, agents, sponsors, volunteers, and employees (the “releasees”) from and against any and all liabilities, claims, penalties, losses, or expenses (including attorneys' fees) of any kind or nature whatsoever, whether related to bodily injury, property damage, communicable diseases, illnesses, viruses (including but not limited to COVID-19), or any other form of injury or losses arising out of or in any way related to participation in the activities indicated below by myself and/or any of the minor children listed above. This release includes any losses caused by any negligent act or omission of the releasees. This release does not encompass losses arising from the gross negligence of willful misconduct of the releasees.

If the box for “Great Park Balloon Rides” is checked below, I am aware that the tethered helium balloon ride at Great Park may entail risks, including, but not limited to, injury due to capsize of the passenger gondola, collision with obstacles on the ground or in the air, falling while getting in or out of the balloon gondola, or falling while aboard the balloon in the air or on the ground, death, communicable diseases, illnesses, viruses (including, but not limited to COVID-19), temperature extremes and inclement weather, including wind. For myself and the minor children listed above, I assume full responsibility for these and all other risks, and the risk of bodily injury while participating in tethered helium balloon ride activities at Great Park, whether during preparation, take-off, flight, or landing, whether due to the active or passive negligence of the releasees or otherwise. By signing below, I acknowledge and accept the risks for myself and for any minor participants listed above, and agree that the first paragraph of this release specifically encompasses the losses listed in this paragraph, without limitation to any other losses.

I further give permission to the City of Irvine to take photographs of me or any of the minor children listed above while participating in the activities indicated below for use in future City publicity and understand that I will not receive any compensation for such use.

The City of Irvine takes your privacy seriously. This form asks you to provide the City with certain personal information. Such information is being requested and will be utilized by the City for the specific and limited purpose of future City correspondence regarding the subject-matter of this form. Pursuant to Measure S, an initiative ordinance passed by City voters in 2008, the personal information noted by a double asterisk (**) on this form will be kept confidential. Unless you expressly indicate to us otherwise or unless compelled by a court order, it will not be shared with other agencies, businesses or individuals.
